Abstract

تستند اللامركزية الإدارية على ثلاثة أركان أساسية هي: الاعتراف بالمصالح المحلية المستقلة عن المصالح القومية، والإشراف على هذه المصالح بواسطة هيئات منتخبة، واستقلال الهيئات اللامركزية في ممارسة اختصاصاتها تحت إشراف السلطة المركزية. وفقًا لدستور 1923، تم تحديد هذه المبادئ في المادتين 132 و133، حيث تم الاعتراف بالمديريات والمدن والقرى كشخصيات معنوية مستقلة تُدار من خلال مجالس محلية منتخبة. كما نص الدستور على أن اختصاصات هذه المجالس يجب أن تقتصر على الأمور المتعلقة بمصلحة سكان المنطقة، مع التأكيد على ضرورة أن تكون ميزانياتها وحساباتها معلنة، وللسلطة التشريعية والتنفيذية دور في منع تجاوز حدود اختصاص المجالس أو الإضرار بالمصلحة العامة.

Administrative decentralization is based on three fundamental pillars: recognition of local interests distinct from national interests, supervision of these interests by elected bodies, and the independence of decentralized bodies in exercising their duties under the supervision of the central authority. According to the 1923 Constitution, these principles are outlined in Articles 132 and 133, which recognize directorates, cities, and villages as legal entities managed by locally elected councils. The constitution specifies that the scope of these councils' powers should be limited to matters concerning the interests of the local population, ensuring that their budgets and accounts are transparent. The legislative and executive powers also have a role in preventing councils from exceeding their competencies or harming the public interest.
